Terms and Conditions

Whilst I have every intention of providing a good quality website and service, providing a positive experience for everyone involved, I recognise the benefit for all parties in setting out terms and conditions. I do this not to be overly controlling but to protect the integrity of the site and the content produced.

Terms and Conditions: Mona Lisa Million – 6 May 2010

1. In making a bid you confirm that you have read and accept the Terms and Conditions in full and agree to abide by them.
2. As a winning bidder you do not own the pixels being auctioned, the image, or any part of MisterGoodGuy.com or MonaLisaMillion.com instead you “sponsor” the pixels.
3. Any reference to “own”, “owning”, “owner” or “ownership” is used for convenience only.
4. Winning bidders, subject to meeting the terms and conditions, will have their website linked from the Mona Lisa Million image.
5. And subject to adhering to the terms and conditions, the link and your sponsorship of that link, will remain in place until 28 February 2015.
6. Your site will be linked from the image usually within 2 full working days after payment has been made.
7. You may submit a non-animated .gif or .jpg image of corresponding size to the pixels you sponsor. This image will be displayed as a mouseover action on the Mona Lisa image.
8. The mouseover image will be added usually within 2 full working days of receipt.
9. You may submit a text of 140 characters (including spaces) to accompany the mouseover
image.
10. The 140 character text will be added usually within 2 full working days.
11. You will be invited to submit a 250 word text relevant to your linked website.
12. The text may contain two anchored text link (of reasonable length) back to your site. The text and link will be published at a convenient juncture, and usually within 7days.
13. I’ll supply an image to accompany your text, usually a screenshot of your site. You may if you wish provide your own graphic (subject to approval).
14. When all the lots are sold or have otherwise been taken, the top ten winning bidders will be invited to supply a 300 word text relevant to their site and containing two anchored text links back to their site.
15. All winning bidders will be linked to from the “Mona Lisa main page” with the newest winning bidder at the top. This link will be your site name.
16. Any other links to your site beyond the commitment stated above will be at my discretion and I reserve the right to highlight high profile bidders in the interests of publicising the site and increasing readership.
17. This is not open to you if your site, service or product is, or appears to be, unlawful, misleading, bogus, false, of dubious value, spam, a trick, a scam, offensive, racist, sexually explicit, salacious, political, incites or intends to incite another person to commit an unlawful act, defamatory, slanderous, libelous material. And specifically sites relating to: pharmaceuticals; tobacco, drugs; prescription drugs; narcotics; diet pills; acai; cialis; viagra; male enhancement/enlargement; multi level marketing; pyramid schemes; get rich quick schemes; “magic bullet” schemes, online gambling or betting, online casinos, online bingo, online poker; sites selling links or traffic; promises of free money; protest websites; political websites; dubious financial solutions; made for adsense sites, sites immediately redirecting to an affiliate link.
18. This is not open to any other site not deemed suitable or not in keeping with my project and detrimental to MisterGoodGuy.com and MonaLisaMillion.com, my readership and my other sponsors. I will be the final arbiter in deciding who may be linked from MisterGoodguy.com and MonaLisaMillion.com and if you are in any doubt about the eligibility of your site service or product you may contact me via eBay’s ‘Ask Me A Question’ for pre-approval.
19. An existing sponsor who changes their content to include any of the above (17 & 18) will be in breach of the terms and conditions.
20. You may not transfer the link either by request or via redirection to another website, doing so will forfeit your sponsorship. Only in very exceptional circumstances will this be permitted.
21. If you redirect your site and it appears you have done so to circumvent the terms and conditions, you will be considered to have breached the terms and conditions and you forfeit your ‘sponsorship’.
22. You may not change the images or the link(s) to your site, so choose carefully. Although, changes may be made in case of typographical errors or in exceptional circumstances but beyond that I may either decline to make changes or levy an administration fee.
23. You must own or legally control the site you wish to link to.
24. Any images or text you supply must be owned by you or you must have verifiable permission to use them. Any text or images breaching copyright or intellectual rights may be removed.
25. Auction winners will be contacted within two full working days and asked to supply the address of the website they wish to link to.
26. If you are the winning bidder and you do not meet the requirements set out in the terms and conditions you will be courteously notified by email or through the eBay messaging system. I will ask you to agree to cancelling the transaction through eBay’s resolution center. If you do so, neither of us will incur costs.
27. If your site meets the standards as outlined in the terms and conditions I will contact you requesting the information needed to carry out the transaction along with a request to make payment.
28. Once payment has been received I will publish your links, text and images as described above.
29. Payment is made through paypal in US Dollars
30. Once you make payment you have 7 full working days in which to request a refund. The refund will be at 80% of the value paid to cover costs and fees incurred by me.
31. After 7 working days, no refunds will be given.
32. At any point beyond the first seven days you may elect to have your links and images removed, but you will not be refunded.
33. Your link may be suspended long enough for me to investigate any suspected breach. You will not be compensated for any link downtime.
34. If a refund is given all links and references to your site may be deleted from Mistergoodguy.com and MonaLisaMillion.com
35. If you breach the terms and conditions all links, images, and text may be deleted from MisterGoodGuy.com and MonaLisaMillion.com.
36. If you forfeit, discontinue, or otherwise allow your site to lapse I may suspend or remove your links images and text.
37. If you sell or transfer ownership of your site you must notify me by email and the new owner must agree to the terms and conditions.
38. If your conduct or future conduct brings MisterGoodGuy.com or MonaLisaMillion.com into disrepute you will be in breach of the terms and conditions.
39. Site downtime will be kept to a minimum, as extended periods of downtime benefit neither party, but there will be no compensation offered in the event of any downtime.
40. At any point I may sell or transfer ownership of the sites as suits my personal circumstances, but if I do so, it will be on condition that the prospective owner enters into a legally binding contract to either continue the project to its five year conclusion or reimburse all winning bidders to the full amount paid.
41. As an existing sponsor your images, text and anchored links must be approved by me. They may not be offensive, sexually explicit, and they must be of a reasonable file size.
42. MisterGoodGuy.com and MonaLisaMillion.com are published with the intention of being suitable viewing for all age groups.
43. I cannot guarantee the quality of products, services or sites linked to from MisterGoodGuy.com or MonaLisaMillion.com, and the links and text are not to be taken as my recommendation or endorsement.
44. Pixels purchased in ways other than bidding are subject to the conditions above
45. Sections of the Mona Lisa Image ‘gifted’ to you by me, are subject to these terms and conditions save for those relating to auctions and refunds as they do not apply.
46. Working days are Monday through to Friday.
47. Pixels left vacant through request or through breach of terms and conditions may be re-auctioned.
48. In the event of my becoming incapable of administering the sites through illness, injury or death, neither my family nor I shall be held liable.
49. I reserve the right to adapt and improve the websites. Whilst I have tried to envisage all considerations in setting up the websites, it is a new venture and I cannot possibly foresee all eventualities.
50. I reserve the right to change the terms and conditions without notice. You will be notified when changes (other than typographical and layout changes) take place via an ‘administration update’ posted at MisterGoodGuy.com
